By downloading, installing, or using the PAINKLLR mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If we make material changes, we will notify you. Your continued use of the App after such changes constitutes acceptance of the updated Terms.
You must be at least 13 years old to use the App. Users between 13 and 18 must have parental or guardian consent. We do not knowingly collect personal information from children under 13.
You agree to provide accurate information, maintain the security of your password, update your information promptly, and accept responsibility for all activity under your account. Report any unauthorized access immediately to admin@painkllr.com.
The training content, calculated targets, and fitness recommendations in the App are not intended as medical advice, diagnosis, or treatment. You should consult your healthcare provider before beginning any exercise program. Physical activity carries inherent risks including injury and death, which you voluntarily assume.
RSVPs do not guarantee admission. Event details may change without notice. By attending, you consent to photography and recording unless otherwise notified. You assume full responsibility for your safety and conduct at all events.
Participation requires a valid account and confirmed RSVP. Attendance may be required. Winners are selected randomly. Prizes are non-transferable and non-exchangeable. Partner information sharing is permitted as disclosed at the time of entry.
All content in the App is owned by or licensed to PAINKLLR. PAINKLLR® and Growth Over Fear® are registered trademarks. You are granted a limited, personal-use license. Commercial exploitation is prohibited without written consent.
You agree not to: use the App for unlawful purposes, attempt unauthorized access, interfere with servers, transmit malware, misrepresent your identity, harass other users, scrape data, use automated access tools, or circumvent security measures.
We may suspend or terminate your account at any time without notice. You may request account deletion by contacting admin@painkllr.com.
Third-party links are provided for convenience only. We do not control or endorse external content. Your use of third-party services is governed by their respective terms.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
PAINKLLR shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our maximum liability is capped at $100 or the amount you paid in the prior 12 months, whichever is greater.
You agree to indemnify and hold harmless PAINKLLR from any claims, damages, and expenses arising from your use of the App or violation of these Terms.
We will first attempt informal resolution. Unresolved disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association in Travis County, Texas. You waive the right to participate in class action lawsuits.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
PAINKLLR, not Apple, bears sole responsibility for the App. Your license is limited to personal use on Apple devices you own or control. Apple has no warranty or support obligations. Apple is a third-party beneficiary of these Terms.
If any provision of these Terms is found invalid, that provision shall be limited or eliminated to the minimum extent necessary. All remaining provisions remain in full force and effect.
These Terms and our Privacy Policy constitute the complete agreement between you and PAINKLLR, superseding all prior understandings.
